"[Black Confederates] didn't exist....that's what I discovered after 10 years of research."

I still say the final line of Levin's book should have been "Sorry, folks, I didn't find them."

Black Confederate is not in the wording of the law...

Early in the twentieth century, most southern states expanded their pension laws to offer compensation to black men and women who had worked on behalf of the Confederacy, but those laws contained no provisions suggesting that black men could claim pensions as soldiers.

I review historian Kevin M. Levin's new book on the Myth of the Black Confederates. This fell-good fairy tale was fostered by the Sons of Confederate Veterans and spread along with other junk history on the internet. Levin looks at the real role of African Americans in the Confederacy, the historical distortion wrought by those trying to paint the Confederacy as a multi-cultural freedom movement, and the ways historians are fighting back.

There's nothin mythical about Black Confederate troops.

“There are at the
present moment, many colored men in the Confederate Army doing duty
not only as cooks, servants, and laborers, but as real soldiers,
having muskets on their shoulders and bullets in their pockets, ready
to shoot down loyal troops and do all that soldiers may do to destroy
the Federal government and build up that of the traitors and rebels.
(Fredrick Douglass)

“For more than two years, Negroes had been extensively
employed in belligerent operations by the Confederacy. They had been
embodied and drilled as rebel soldiers and had paraded with white
troops at a time when this would not have been tolerated in the armies
of the Union. (Horace Greeley)

Visually, how black is the minimum black a Black Confederate must be to be a Black Confederate?

That's the complicated part some could pass for white. From the photos Iv'e seen they seamed Black enough. But due to not all documentation existing or surviving or easily accessible, and other factors the numbers will most likely never be certian.

So if there were tens of thousands of black Confederate troops then why the Jim Crow discrimination? Why the miscegenation laws?

Yet we don't find said Confedrate soldiers mentioned by Union or Confedrate troops or in prison camps. We don't have very many applications for state pensions paid by Southern and border States for Confedrate veterans of color.

Actually there are many accounts I'll dig around, here see this quote first then I'll go find it all.

“Over 3,000 Negroes must be
included in the number. . . . They had arms, rifles, muskets, sabers,
bowie-knives, dirks, etc. They were supplied, in many instances, with
knapsacks, haversacks, canteens, etc., and they were manifestly an
integral portion of the Southern Confederacy army. They were seen
riding on horses and mules, driving wagons, riding on caissons, in
ambulances, with the staff of generals and promiscuously mixed up with
all the Rebel horde”. (Capt. Isaac Heysinger).

Best to have evidence in hand when claiming it exists. My standard for a Black Confederate Soldier is a photo of a Nubian black in an immaculate gray (or butternut) uniform shooting in the direction of a Union soldier.
